Police say the shooting happened around 3 p.m. on Christmas Day outside a Red Rooster location in Miami.

Investigators say the man had been having brunch with his mother, 50 year old Roseita Lavette Smith. During the meal, Smith allegedly accused her son of being disrespectful toward her and other family members. What may have started as a verbal disagreement soon followed them outside.

According to the arrest report, the argument continued into the restaurant parking lot and inside Smith’s vehicle. At some point, both exited the car.
